1. About these terms
These Terms of Service (“Terms”) govern your use of machinecinema.ai and any related services, events, and community spaces operated by Machine Cinema (“Machine Cinema,” “we,” “us”). By accessing the site, subscribing to our newsletter, or participating in our programs, you agree to these Terms.
If you do not agree, please do not use the site or join our community.
2. What we offer
Machine Cinema is a global community for creators exploring AI as a creative medium. We run events (including our GenJam™ workshops), publish a newsletter, host community channels, and connect creators with each other and with partners. Most of what we do is free; some programs have application or partnership components with their own terms.
3. Eligibility
You must be at least 13 years old to use the site. Some programs and events have their own age and eligibility requirements, which will be stated at the point of registration.
4. Our intellectual property
The site, the Machine Cinema name, and our logos, illustrations, and other content are owned by Machine Cinema and our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission, except as allowed for personal, non-commercial use or as expressly permitted in our media kit.
GenJam™ is a trademark of Machine Cinema. If you’re interested in hosting an official GenJam™ event, contact us first — we’ll talk you through it.
5. Your content and submissions
If you submit anything to us — including messages through our forms, applications, work shared in our community, feedback, or ideas — you keep ownership of your work. By submitting it, you grant Machine Cinema a non-exclusive, royalty-free, worldwide license to use, store, and display that submission for the purpose of operating and improving our community and programs.
You’re responsible for what you submit. Don’t share anything you don’t have the right to share.
6. Acceptable use
When using the site or participating in our community, you agree not to:
- Use the site or community for anything illegal, harmful, or harassing
- Attempt to access or interfere with the site’s infrastructure, scrape it at scale, or bypass any security measures
- Impersonate anyone, including Machine Cinema staff or community members
- Send spam, phishing, or other unsolicited communications through our forms
- Use our trademarks in a way that suggests endorsement or sponsorship that doesn’t exist
- Upload content that infringes anyone’s intellectual property or privacy rights
7. Events and community spaces
Our events and community channels have their own codes of conduct. By attending or participating, you agree to those rules. We may remove anyone from an event or channel for behavior that violates them.
Events may be photographed, recorded, or live-streamed. If you don’t want to appear in event media, let an organizer know on the day, and we’ll do our best to honor that.
8. Third-party links and services
The site links to third-party services like Substack, Discord, Luma, and our partners’ sites. We’re not responsible for the content or practices of those services. Their terms apply when you use them.
9. Disclaimers
The site and our content are provided “as is” and “as available”. To the fullest extent permitted by law, Machine Cinema disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Anything we publish about AI tools, workflows, or events is provided for informational and educational purposes only. You make your own decisions about what to build, what to share, and what tools to use.
10. Limitation of liability
To the fullest extent permitted by law, Machine Cinema and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or our programs. Our total liability for any claim related to the site or our services will not exceed one hundred US dollars (US$100).
Some jurisdictions don’t allow these limits. Where that’s the case, they apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Machine Cinema, its team, and its partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the site, your submissions, your participation in our community, or your violation of these Terms.
12. Changes to the site or these terms
We may change, suspend, or discontinue any part of the site or our programs at any time. We may also update these Terms. When we make material changes, we’ll update the “last updated” date and, where appropriate, notify the community through the newsletter or other channels. Continued use of the site after changes means you accept them.
13. Termination
We may suspend or terminate your access to the site or community at any time, with or without notice, if we believe you’ve violated these Terms or if doing so is necessary to protect the community. You can stop using the site at any time.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any dispute that can’t be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
If you’re in another country, mandatory consumer protection laws in your jurisdiction may also apply to you.
15. Miscellaneous
If any part of these Terms is held to be unenforceable, the rest stays in force. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy Policy and any event-specific or program-specific terms, are the complete agreement between you and Machine Cinema regarding the site.
16. Contact
Questions about these Terms can go to affan@fantastic.day.
Plain-English summary
Use the site, read the newsletter, come to our events, share work in our community — just be cool about it. Don’t copy our logo into your own product, don’t spam our forms, and don’t run a paid “GenJam” without talking to us first. We do our best to keep things running but we can’t guarantee uptime or that everything we publish will be perfect.
